1. Eligibility

You must be at least 13 years old to use Olly Posture. By using the App, you represent that you meet this age requirement.

2. Not Medical Advice

Olly Posture is not a medical organization.

The stretching and strengthening routines, text, graphics, and images provided in the App are for informational and educational purposes only.

Consult a Professional

Always seek the advice of a physician or qualified physical therapist before starting any new exercise program, especially if you have pre-existing back, neck, or spinal conditions.

No Professional Relationship

Your use of Olly Posture does not create a doctor-patient or therapist-client relationship.

Assume the Risk

By using this App, you voluntarily assume all risks of injury. If you feel pain, dizziness, or discomfort at any point, stop immediately.

3. Subscriptions and Payments

Olly Posture offers premium features via subscription.

Billing

Subscriptions are processed through the Apple App Store or Google Play Store via RevenueCat. By starting a subscription, you agree to the respective store's payment terms.

Auto-Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

Cancellations

You must manage and cancel subscriptions through your Apple ID Account Settings or Google Play subscriptions. We cannot manually process refunds or cancellations as transactions occur between you and Apple or Google.

Price Changes

Subscription prices may change. We will notify you of any price changes, and you may cancel before they take effect.

4. Free Version and Advertising

The free version of Olly Posture is supported by advertisements provided by Google AdMob. By using the free version, you consent to the display of ads. Premium subscribers enjoy an ad-free experience.

5. Use of the App

License

We grant you a personal, non-exclusive, non-transferable, revocable license to use Olly Posture for personal, non-commercial use.

Local Storage

You acknowledge that Olly Posture stores your progress data in a local database on your device. We do not back up this data. If you delete the app or lose your device, your data will be permanently lost.

Service Availability

Some App features, including exercise images and videos, are hosted on third-party services. We do not guarantee uninterrupted access to these features.

6. Third-Party Content

The App may contain links to third-party content, including YouTube videos demonstrating exercises. We are not responsible for the accuracy, availability, or content of these third-party resources. Your use of third-party content is subject to their respective terms of service.

7. Prohibited Uses

You agree not to:

Use the App for any unlawful purpose
Attempt to reverse-engineer, decompile, or disassemble the App
Scrape, harvest, or collect data from the App
Redistribute, sublicense, or resell access to the App
Interfere with or disrupt the App's functionality
Use the App to harm or exploit minors

8. Intellectual Property

All content within the App, including the specific sequence of routines, UI design, logos, illustrations, and instructional text, is the property of Olly Posture and is protected by copyright and trademark laws.

9. Indemnification

You agree to indemnify and hold harmless Olly Posture, its developers, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the App or violation of these Terms.

10. Limitation of Liability

To the maximum extent permitted by law, Olly Posture and its developers shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to personal injury, pain and suffering, or data loss arising out of your use of the App. Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $50, whichever is greater.

11. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

12. Dispute Resolution

Informal Resolution

Before filing any formal dispute, you agree to contact us at support@ollyposture.com and attempt to resolve the matter informally for at least 30 days.

Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict of laws principles.

Jurisdiction

Any disputes not resolved informally shall be resolved in the state or federal courts located in Nevada.

13. Modifications to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Effective Date" and, where feasible, providing notice within the App. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

14. Termination

We reserve the right to suspend or terminate your access to the App at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or us. Upon termination, your license to use the App is revoked.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
